By accessing or using the Omma platform at omma.build ("Service"), operated by Spline, Inc. ("Spline", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and Spline, Inc. and apply to all visitors, users, and others who access or use the Service. By using the Service, you represent and warrant that you have the legal capacity to enter into this agreement.
Omma is an AI-powered creative studio operated by Spline, Inc. that enables users to build interactive experiences, 3D scenes, websites, games, and applications using natural language. The Service includes, but is not limited to:
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
You must create an account to access certain features of the Service. When creating your account, you must provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you represent that you have your parent's or legal guardian's permission to use the Service. We reserve the right to terminate accounts that we discover are held by users under the age of 13.
You must notify us immediately at support@omma.build if you suspect any unauthorized use of your account. Spline, Inc. is not liable for any loss or damage arising from your failure to protect your account credentials.
Omma offers free and paid subscription plans. Paid plans are billed on a recurring monthly basis and include a monthly allocation of credits. Credits are consumed when you use AI-powered features such as code generation, image generation, and 3D model generation. Unused monthly credits do not roll over to subsequent billing periods.
All fees are stated in U.S. dollars and are non-refundable except as required by applicable law. You authorize us to charge your selected payment method for recurring subscription fees. We may change pricing at any time, but will provide at least 30 days' notice before any price increase takes effect on your account.
You may cancel your subscription at any time through your account settings or by contacting support@omma.build. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
Your Content: You retain all ownership rights to content you create using the Service, including generated code, images, 3D models, and published projects. Spline, Inc. does not claim ownership of your creations. By using the Service, you grant Spline, Inc. a limited, non-exclusive license to host, store, and display your content solely as necessary to provide the Service to you.
Our Service: The Service itself, including its software, design, branding, documentation, and all associated intellectual property, is owned by Spline, Inc. and protected by copyright, trademark, and other intellectual property laws. The Omma name, logo, and all related marks are trademarks of Spline, Inc. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.
Feedback: If you provide feedback, suggestions, or ideas about the Service, you grant Spline, Inc. an unrestricted, irrevocable, perpetual license to use such feedback for any purpose without compensation to you.
You agree not to use the Service to:
We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use provisions.
When you publish content to the Omma community, you grant other users a non-exclusive, royalty-free license to view and fork your published projects for their own use. You represent that you have the right to share any content you publish to the community.
Projects are publicly accessible by default. You may control the visibility of your projects through your account settings. You are solely responsible for the content you publish and share through the Service.
Spline, Inc. reserves the right to remove any community content that violates these Terms or that we deem inappropriate, without prior notice.
The Service integrates with third-party AI providers (such as Anthropic, Google, and OpenAI) and other services (such as payment processors and cloud infrastructure providers). Your use of these third-party services is subject to their respective terms and policies. Spline, Inc. is not responsible for the availability, accuracy, or practices of any third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. SPLINE, INC. DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
AI-generated content may contain errors, inaccuracies, or inappropriate material. You are solely responsible for reviewing and validating any content generated through the Service before using it in production or distributing it.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SPLINE, INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
IN NO EVENT SHALL SPLINE, INC.'S TOTAL AGGREGATE LIABILITY EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO SPLINE, INC. IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Spline, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the Service; your violation of these Terms; your violation of any rights of another party; or any content you create, publish, or distribute through the Service.
We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of account termination by contacting support@omma.build.
Sections relating to intellectual property, limitation of liability, indemnification, governing law, and any other provisions that by their nature should survive termination shall survive the termination of these Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date at the top of this page. For significant changes, we may also notify you via email. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision. These Terms constitute the entire agreement between you and Spline, Inc. regarding the Service and supersede all prior agreements.
